An Appeal to Reason is written by experienced appellate attorney, Donna Bader, who advises trial attorneys on what they need to do, or not do, at the trial court level to protect their cases on appeal. This is a crucial time for setting up an appeal. Quite often, trial attorneys try cases without paying much attention on how to preserve the record, object properly, and other important subjects. The book presents 204 strategic tools, advising trial attorneys on how to win their appeals at the trial level.
An Appeal to Reason 204 Strategic Tools to Help You Win Your Appeal at Trial Donna Bader 9780983620402 Books
Donna Bader's new book, An Appeal to Reason, serves as the perfect guide for any trial attorney seeking to protect his or her client's rights on appeal. An Appeal to Reason is her latest effort to empower trial lawyers with the knowledge they need to ensure success through an appeal. As unequivocally set forth in the Introduction "trial attorneys cannot ignore the need to understand the appellate process." An Appeal to Reason plays well to all levels of attorneys, clearly and concisely guiding the reader through important aspects of the appellate process throughout litigation and providing invaluable tips on how to protect client interests each step of the way. Donna pointedly and repeatedly counsels that once the trial is over, it is often too late. This truism is attacked head-on in Donna's practical and approachable book.An Appeal to Reason provides 204 tips over nine chapters, each chapter concluding with "Tips for Success" recapping the key points of the section (which are alone worth the price of admission). Each chapter begins with a factual scenario (which most litigators will quickly recognize) that helpfully places the information that follows into a trial lawyer-friendly context.
The full text of each tip is presented in a succinct manner that similarly caters to its target audience - busy trial attorneys - and provides the necessary information in an easy to read fashion, including key legal authorities.
Simple and straightforward advice pervades An Appeal to Reason regarding all aspects of litigation. Practical tips at various steps of litigation include:
1. anticipating a motion for summary judgment when signing up a case (so you can begin gathering necessary declarations early and be best prepared to oppose the motion)
2. appeal a Judgment of Dismissal, not an Order sustaining a demurrer without leave to amend (so your appeal will be procedurally correct)
3. moving to strike a response from the record if the trial judge sustains your objection (so the record will accurately reflect the state of the evidence based on the judge=s rulings)
These recommendations and others throughout the book make this a must-read for anyone trying cases. This book is not a "how to" for a lawyer looking to write their own appeal, but rather a "how to" make sure your case will be best positioned in the event of an appeal.
An Appeal to Reason succeeds in providing easy to understand and easy to implement ways to ensure a trial attorney's client's interests are best protected throughout litigation. Whether a trial veteran or trying one's first case, this book provides a perfect overview of what to do (and not to do) to help ensure the best chances of making sure that any success achieved at the trial level survives the scrutiny on appeal.

An Appeal to Reason 204 Strategic Tools to Help You Win Your Appeal at Trial Donna Bader 9780983620402 Books Reviews
For many trial attorneys the bridge between the trial practice and appellate process is a drive in the fog. Donna Bader's book will not only make that drive a clearer one, but can help to eliminate the trip completely. Win the verdict, keep the verdict. Sounds good to me.
After reading Ms. Bader's An Appeal to Reason, I promptly bought copies for the newest attorneys in the family. Since my first reading, I've had this eerie impulse to "look over my shoulder" at objections I didn't make, statements of decision I didn't request, not realizing then the impact of that oversight. Bader's book is important for any attorney who walks into a courtroom, let alone for a trial. The book could also be titled "204 ways of screwing up an appeal without even trying" as all of us will recognize ourselves in more than one of these "Tools." The second reading was in parts, lifting citations and creating trial notes. The tips, from an appellate court's viewpoint, are incisive and thought-provoking. This is a valuable book that trial lawyers better read, if for no other reason than the off chance their clients might.
